1. Services Provided

1.1. The Service Provider offers digitization of physical media, including DVDs, Blu-rays, and VHS tapes, into digital file formats.

1.2. Optional setup of a Plex Media Server, including library organization and metadata tagging.

 

2. Customer Responsibilities

2.1. The Customer confirms that they are the legal owner of all physical media submitted for digitization.

2.2. The Customer agrees that all digitized files are for personal use only and will not be distributed, sold, or shared in violation of copyright laws.

2.3. The Customer acknowledges that duplication of copyrighted materials for purposes other than personal use is prohibited under the Digital Millennium Copyright Act (DMCA) and other applicable laws.

 

3. Copyright and Legal Compliance

3.1. The Service Provider does not endorse or facilitate unlawful copying, reproduction, or distribution of copyrighted materials.

3.2. The Service Provider reserves the right to refuse services if the media provided appears to be in violation of copyright laws.

 

4. Liability Disclaimer

4.1. The Service Provider is not responsible for any legal issues arising from the Customer’s use of the digitized media.

4.2. The Service Provider is not liable for damage to media caused by pre-existing conditions, age, or deterioration of the original materials.

4.3. While reasonable efforts are made to ensure the integrity of digitized files, the Service Provider cannot guarantee error-free results due to the condition of the original media.

 

5. Data Handling and Privacy

5.1. Digitized files will be securely transferred to the Customer using the agreed-upon method (e.g., external drive, cloud transfer, etc.).

5.2. The Service Provider will delete all digitized files from its systems within 30 days after successful delivery.

5.3. The Service Provider will not share, sell, or distribute any Customer data to third parties.

 

6. Payment and Refund Policy

6.1. Payment is due upon delivery of services unless otherwise agreed in writing.

6.2. Refunds are not available for completed services but may be considered on a case-by-case basis for issues directly caused by the Service Provider.

 

7. Governing Law

This agreement shall be governed by the laws of the State of Michigan. For Customers outside of Michigan, relevant federal laws of the United States will apply.

 

8. Dispute Resolution

8.1. Any disputes arising from this agreement shall first be resolved through good faith negotiation.

8.2. If unresolved, disputes shall be settled through binding arbitration in Middleville, Michigan, unless both parties agree otherwise.

 

9. Indemnification

The Customer agrees to indemnify and hold harmless the Service Provider from any claims, damages, losses, or legal fees arising from misuse of the digitized files or any breach of these Terms and Services.

 

10. Entire Agreement

These Terms and Services constitute the entire agreement between the Customer and the Service Provider and supersede all prior communications and agreements.

By proceeding with our services, you confirm that you have read, understood, and agree to these Terms and Services.
